Will of Peter Day proved on 2 January 1761 in the Archdeaconry Court of Canterbury -------------------------------------------------------------------------- -------------------------------------------------------------- In the Name of God Amen I Peter Day of Biddenden, Kent in the County of Kent Yeoman being in good health in body and of sound and perfect mind and memory (praised be God) do this second day of January in the thirty third year of the Reign of our Sovereign Lord George the second by the Grace of God of Great Britain France and Ireland King Defender of the failth and so forth and in the Year of our Lord one Thousand seven hundred and Sixty make and ordain this my last Will and Testament in following First and principally I recommend my Soul to Almighty God who gave it and my Body in hopes of a joyfull Resurrection through the atonements death and passion of my blessed Redeemer Jesus Christ I Commit to the Earth to be decently buried at the discretion of my Executor hereinafter named and ???? that Worldy Estate wherewith the Lord in mercy hath been pleased to bless me I Give and dispoes thereof as followeth I give and bequeath unto my Eldest Son Peter Day the Sum of Twenty pounds of lawfull money of Great Britain to be paid at the end of three months next after my Decease by my Executor hereinafter named Also I Give Devise and bequeath to my said son Peter Day his heirs executors administrators and assigns all that my plot or spot of ground which is now planted with hops with all the hop poles which now are and which shall be thereon at my decease lying and being in the aforesaid parish of Biddenden, Kent and now in my possession Also I give and bequeath unto my son William Day the sum of twenty pounds of lawful money of Great Britain to be paid to him by my executor in manner following that is to say the sum of five pounds part thereof at the end of twelve months next after my decease and the further sum of three pounds a year for the next five years by half yearly payments If the same shall be desired to be paid half yearly Also I give and devise unto my two sons James Day and Charles Day all that my piece or parcel of woodland containing in the whole by estimation eighteen acres more or less with the soil and ground thereof and all the lumber and trees and underwood growing and being thereon together also with the poll of young trees and the outrunning and appertenances to the said woodland belonging or appertaining lying and being in Biddenden, Kent aforesaid near a certain place called Castleden Oaland now in my own possession to have and to hold the said piece or parcel of woodland with the soil ground under and all the appertenances thereunto belonging unto the said James Day and Charles Day their heirs and assigns for ever as tenants in common and not as joint tenants but in case my said sons James and Charles shall both happen to die and leave no issue lawfully begotten or if they or either of them shall leave issue and such issue shall happen to die under the age of one and twenty years then it is my desire and will that my other sons Peter and William and their heirs shall have and enjoy the same Also I do hereby nominate constitute and appoint my said son Charles Day sole executor of this my last will and testament and after all my debts funeral expenses the charge of proving this my last will and the aforesaid legacies shall be paid I give and bequeath all the residue and remainder of all my ready money goods chattels and personal estate of what sort so ever and wheresoever unto my said executor And lastly I do hereby revoke and make void all former wills by me made and declare this to be my last will and testament In witness whereof I the said Peter Day the testator to this my last will and testament contained in one whole sheet of paper and this part of a sheet have sett my hand and seal to both sheet dated the day and year first within written Peter Day Signed sealed published and delivered by the said Peter Day the testator as his last will and testament in the presence of us who have hereunto in his presence subscribed our names as witnesses several words being first outerlined in both sheets Jno.
