I Charles Day of Biddenden, Kent in the County of Kent Yeoman do hereby revoke
all Wills and other Testamentary Dispositions by me at any time heretofore
made and declare this to be my last Will and Testament I Give and Bequeath to
my Nephew Richard Day all my Household Goods & furniture Plate inen & China
and all my Husbandry Tackle and Implements of Husbandry Hores Bullocks Corn
Hops Sheep Cattle and Chattels  whatsoever now being or which shall be at the
Time of my Decease in upon about or belonging to the Messuage or Tenement Farm
Land & Premises now in my own Occupation Aso the use & Occupation of the said
Farm he the said Richard Day payng my Funeral Expenses also my just Debts &
such Money as I shall hapen to owe for Rent at the Time of my Decease Also I
forgive the said Richard Day all sum and sums of Money that he shall or may
stand indebted to me at the time of my Decease I give and bequeath all my
ready Money, Securities for Money and all my Personal Estate whatsoever
(excepting what I have above given to the said Richard Day) unto my Nephew
John Day of Biddenden, Kent aforesaid Yeoman Richard Beale of Biddenden, Kent
aforesaid Gentleman and Charles Nairn of Milkhouse in the Parish of Cranbrook
in the said County Gentleman their Executors & Administrators In Trst that
they the said John Day Richard Beale and Charles Nairn or the survivors or
survivor them or the Executors or Administrators of such survivor shall and do
as soon as conveniently may be after my Decease pay and apply & divide the
said Trust monies and Securities for Money unto and amonst my nephews Peter
Day James Day the said John Day and Thomas Day and my Nieces Esther Wife of
Thomas Brunger Mary the Wife of Thomas Carpenter Elizabeth the Wife of Richard
Weston and Wife of Luckhurst equally to be divided between them and each and
every of them share and share alike And I do hereby nominate constitute and
appoint the said John Day Richard Beale and Charles Nairn Executors of this my
last Will and Testament And my Will and mind is that my Executors and Trustees
or either of them their or either of their Executors or Administrators shall
not be chargeable with or accountable for more Monies than they shall actually
receive nor with or for any Loss of the same monies so as the same happens
without their wilful Neglect or Default the one for the other of them but each
of them only for his own Acts Deeds and Defaults And also that it shall and
may be lawful for my said Trustees ?????? ????? himself and themselves
respectively all such Losses costs Charges Damages and Expenses as they shall
sustain or be put unto in the Execution of the Trusts aforesaid together with
a reasonable Allowance for their Trouble and Loss of Time in and about the
premises In Witness whereof the said Charles Day the Testator have to this my
Last Will and Testament set my Hand and Seal this first day of January one
Thousand seven hundred and ninety five .//.  Charles Day  Signed Sealed
Published & Declared Charles Day the Testaor as and for his Last Will &
Testament in the presence of us who at his equest in his Presence and in the
Presence of each other have subscribed our names as Witnesses thereto ~ Stepn

The before Registered Will of Charles Day deceased was proved the twentieth
Day of August 1795 before the Revd Joshua Dix Surrogate to the Worshipful Sir
Wm Scott Knight Doctor of Laws Official General to the Revd the Archdeacon of
Canterbury lawfully constituted by the Oath of John Day the Nephew one of the
Executors named in the said Will he being first sworn duly to perform the ????
???? ???? to Richard Beale and Charles Nairn the other Executors
